This motion overrides the Governor's veto of a bill that expands the ability of individuals to sell homemade food products, including some cottage food products that may be "potentially hazardous or require time or temperature control for safety." Expanding Food Freedom and Consumer Choice by Reducing Restrictions on Sales of Certain Homemade Food Products.

This bill requires the Arizona Corporation Commission to conduct annual safety inspections of all railroads and railroad tracks in the state. This is on top of federal regulations as well as the existing state law requiring the commission to establish standards of safety and safety devices. This bill, the "Preventing International Influence on Public Health Emergencies Act of 2023", prohibits the state and local government from using any resources to enforce a public health emergency order that is based on "an agreement or recommendations from an international governmental organization", such as the World Health Organization. Strengthening Individual Liberties by Placing Limits on "Public Health Emergencies".

This bill expands upon the existing requirement that before a municipality adopts a zoning ordinance or amendment, it consider the "probable impact" on housing construction costs. Under this bill, the municipality must consider a "housing impact statement" that includes "a general estimate of the probable impact" on housing construction costs, "a description of any data or reference material" the ordinance or amendment is based on, and "a description of any less costly or less restrictive alternative methods of achieving the purpose" of the ordinance or amendment. Support is the Limited Government Position as, like all government central planning attempts, many of the zoning and land use ordinances enacted across the state are overreaching and oftentimes designed to benefit select developers and landowners. Combatting Government Overreach by Requiring Localities to Consider a Housing Impact Statement Before Adopting Zoning Ordinances or Amendments.

This bill mandates that all retail establishments accept cash for transactions of $100 or less. Oppose is the Limited Government Position as this measure places a significant regulatory barrier on "automated marketplaces" and businesses in high-crime areas. While there are legitimate concerns for government attempting to eliminate cash and create its own digital and trackable currency, such issues should be addressed in targeted legislation as opposed to this overreaching mandate that harms businesses.

Preventing Private Businesses from Setting their Own Payment Method Policies by Mandating All Retail Establishments Accept Cash.

This bill allows the Director of the Department of Health Services to establish a licensing regime for dietitians, which requires paying a fee, holding a bachelor's degree, and obtaining a national certification. The license must be renewed every two years. The bill also amends existing law to now require dietitians be licensed to be able to order diets, nutritional supplementation, laboratory tests, and other orders in a hospital. Oppose is the Limited Government Position as this bill represents one of the very worst forms of cronyism and government overreach. This government mandate merely exists to enrich the schools and organizations (who heavily lobbied for the bill) that provide education and credentialling for this service.

Worsening Government Overreach and Cronyism by Imposing a New Licensing Regime on Dietitians to Enrich Educational Institutions.

This bill appropriates $7.5 million annually through FY 2025-2026 to be distributed to community health centers and rural hospitals to cover unreimbursed costs for on-call OB/GYN services "to maintain service availability in low-volume obstetric delivery areas" and rural areas with a population under 350,000. Oppose is the Limited Government Position as this bill further grows spending under the state's Medicaid welfare program. The state must pursue every available avenue to reign in its out-of-control spending, which, when coupled with the over $185 trillion federal liabilities, represents the greatest existential threat facing this country.

Ballooning Medicaid Welfare Spending by an Additional $7.5 Million for On-Call OB/GYN Services.

This bill makes changes to the Arizona Convention Center Development Fund, which provides funds to cities to construct convention centers to attract visitors to the state, with revenues shared between the city and state. Under the bill, the state treasurer is prohibited from withholding any funds from cities in a year in which the Governor declares a state of emergency. The bill also requires that during a subsequent economic and fiscal impact analysis, the Auditor General is required to assume that during the year the state of emergency is declared and the following year, the minimum required attendance was satisfied and the state revenues were at least equal to the distributions. This bill prohibits colleges and universities from enacting or enforcing any rule or policy prohibiting individuals with a concealed carry permit from carrying a concealed firearm on campus. The bill also prohibits rules and policies prohibiting the transportation or storage of firearms. Recipients must also provide a weekly report detailing the actions taken. The bill also requires the Department of Economic Security to cross-check claims weekly against multiple data sources. Finally, employers are required to report previous employees for actions, such as refusing to return to work or failing to appear for a scheduled interview. Support is the Limited Government Position as combatting fraud within the state's unemployment insurance system is critical to maintaining low payroll taxes for businesses, which are forced to pay into the system. While unemployment insurance should not be carried out by government - rather, a system should be established whereby individuals and companies can purchase into a program on the private marketplace - lawmakers have a duty to maintain the integrity of the system.

Fueling Tens of Millions in Wasteful Spending by Extending the Unnecessary Arizona Office of Economic Opportunity for Another 4 Years.

This bill allows individuals convicted of a felony offense involving use or possession of a controlled substance to now receive SNAP benefits as long as they are just in compliance with the terms of their probation, including any drug testing requirements. Previously, a person was required to also meet additional requirements to receive benefits, such as completing a substance abuse treatment program. The bill also eliminates the requirement that the Arizona Department of Economic Security adopt rules imposing more frequent drug testing if the conviction occurred within 24 months of an application for benefits. Oppose is the Limited Government Position as this measure decreases incentives for individuals to become self-sufficient and overcome addiction, which oftentimes leads to intergenerational poverty. Instead of increasing welfare eligibility, lawmakers should work to reduce government barriers to employment and help empower the private sector to care for individuals who are in need.

Discouraging Self-Sufficiency by Decreasing the Requirements Individuals Convicted of Felony Drug Offenses Must Meet to Receive SNAP Benefits.

This bill creates a special 30-day nonresident vehicle registration permit, allowing individuals who live outside Arizona to purchase a vehicle in-person and drive it home, without having to pay a Transaction Privilege Tax (TPT) on the sale. This is similar to the existing 90-day nonresident registration, which exempts non-residents who purchase a vehicle and have it delivered out-of-state from paying TPT. Support is the Limited Government Position as this measure protects vehicle purchasers from being forced to incur additional burdens and costs in order to pick up their vehicle in-person and drive it home, as opposed to having it delivered.

The bill prohibits CBDC issued by the federal government from being the "subject or medium of payment of any contract, security or other similar instrument in this state." Support is the Limited Government Position as President Biden issued an executive order to study creation of such a currency under the guise of protecting consumers from decentralized cryptocurrencies and a way to crack down on financial crimes. This bill makes it a class 2 felony to use a telephone or computer application or program to "knowingly assist in the smuggling of human beings," which includes transportation or use of property intended to conceal a person or help a person flee law enforcement. This bill makes non-governmental organizations subject to criminal penalties for "participating in a human smuggling organization or operation." Additionally, the bill modifies existing law which required a person to be "acting within the scope of employment and in behalf of the enterprise" in order for an organization to be criminally liable. Under this bill, a person must only be "acting on behalf of the enterprise." Support is the Limited Government Position as human trafficking has enormous negative implications on national security and of course devastates victims of the practice and their families. Both Arizona and the U.S. government have duties to secure the border and restore law and order by holding criminals accountable. A recent investigation by the Heritage Foundation's oversight project uncovered an enormous operation being conducted by Catholic Charities to aid illegal immigrants and move migrants across the county.
