Weakening Property Rights through a Nanny-State Ban on Electronic Cigarettes or "Vaping" in Public.

This bill removes the sunset date (makes permanent) a labor mandate relating to usage of sick leave. As a result, all companies with at least 25 employees are now permanently required to allow their employees to utilize up to 5 days of sick leave to attend to an immediate family member. Oppose is the Limited Government Position as it is not the proper role of government to intrude into the private contracting arrangement between employers and employees. Such interference and "one-size-fits-all" mandates may limit the ability of employees to obtain other job benefits which better fit their individual needs. The market already incentivizes employers to offer the most desirable benefits to attract the top talent and retain employees.

Worsening Government Interference in the Private Sector by Making the State's Sick Leave Mandates Permanent.

This bill ensures localities enforce ordinances which ban homeless encampments including "unauthorized public camping, sleeping, or obstruction of sidewalks." The bill also requires the state auditor to conduct an audit and evaluate the success of state and local spending on homelessness programs and services. Finally, hospitals and local governments are prohibited from dropping homeless people off in other areas unless the person previously resided there or there is an agreement in place to accept the person. Strengthening National Security by Banning TikTok and Other Chinese Government-Owned Applications from Being Accessed on State-Issued Devices or Networks.

This bill protects owners of manufactured homes and mobile homes who replace an existing home with a new one by prohibiting local governments from imposing new zoning ordinances or regulations that did not apply to the previous home or property. Support is the Limited Government Position as this measure protects against local government overreach. While some may argue this bill undermines "local control", our founding fathers only recognized three entities within the U.S. Constitution - federal government, state government, and the individual. This bill is designed to incentivize individuals to become college nursing instructors. Under the bill, the Board of Health Care Workforce is authorized to cover up to $100,000 of student loan debt over 5 years for nurses who have a master's or doctoral degree and are a faculty member at a public college or university. Strengthening Public Safety by Enhancing Penalties for Damage or Disruption of Critical Infrastructure.

This bill allows for a referendum on whether to implement a new 0.5% sales tax in Richmond County to raise up to $250 million to fund renovations to the Augusta Entertainment Complex, including replacing the current James Brown Arena. This follows a vote in 2021 in which voters rejected a similar effort to fund a new arena by raising property taxes. Expanding Cronyism and Hiking Tax Rates by Authorizing a Referendum for an Additional Sales Tax in Richmond County to Fund an Entertainment Complex.

This bill reinstates a 3% surcharge on all fines for state traffic violations, with the funds intended to be used by the Georgia Driver's Education Commission to provide driver education and training programs. This surcharge is part of "Joshua's Law," which requires minors to complete a driver education course and satisfy supervised driving requirements before obtaining a driver's license. The state must pursue every available avenue to reign in its out-of-control spending, which, when coupled with the over $185 trillion federal liabilities, represents the greatest existential threat facing this country.

Expanding Wealth Redistribution by Expanding Subsidies for College and other Taxpayer-Funded Tuition Programs.

This bill requires insurance companies to provide a "discount" or rate reduction for single-family residential homes, commercial buildings, and modular homes that are built or retrofitted to resist tornadoes, hurricanes, or other catastrophic windstorm events. Oppose is the Limited Government Position as it is not the role of government to dictate how private insurance companies assess risk and set their policy premiums. Like other price controls, this interference merely distorts the marketplace.

Growing the Regulatory State by Imposing New Mandates on Property Insurance Companies Concerning "Discounts" for Property Retrofits that Resist Natural Disasters.

This bill provides insurance companies greater flexibility to offer incentives that incentivize behavioral change by policy holders, such as improved health or financial wellness. This bill prohibits charging motorists any additional fines or fees beyond the established penalty for illegally passing a school bus, if caught by a camera system. Similarly, motorists may not be charged any additional fines or fees beyond the established penalties and a maximum $25 electronic processing fee for exceeding a posted speed limit in a school zone, if caught by a speed camera. Support is the Limited Government Position as this bill serves as a step in the right direction to helping protect against excessive fines and fees from traffic violation camera systems. These systems have been abused by countless local governments across the nation to produce revenue and also brings up valid concerns regarding civil liberties and the growth of government tracking and surveillance.

Combatting "Taxation through Citation" by Prohibiting Additional Fines and Fees for Certain Traffic Offenses Enforced by Cameras.

This bill expands and extends the "preceptorship training" income tax credit, granted to medical professionals who provide training for medical students. Under the bill, dentists are now eligible for the tax credit, in addition to physicians, physician assistants, and advanced practice registered nurses (APRNs). Additionally, the amount of the credit is increased to $1,000 for all training rotations by physicians and dentists, and $750 for APRNs and physician assistants. This credit had been set to expire in 2023, but the bill extends it through 2028. Oppose is the Limited Government Position as this cronyism dilutes the tax base, shifting tax burdens onto other individuals. Additionally, taxpayers should not be forced to fund the educational costs of individuals who choose to pursue select career paths.

Growing Cronyism and Central Planning through an Extension and Expansion of Income Tax Credits for Medical Professionals who Provide Training Services.

This bill contains several provisions designed to reduce barriers for charter schools. This bill, the Safe at Home Act, establishes a series of new regulations on landlord-tenant agreements and the eviction process. Under the bill, the eviction proceeding process is lengthened by now requiring landlords to wait 3 days before initiating an eviction against a tenant who fails to pay rent. Additionally, landlords are prohibited from requiring a security deposit that exceeds two months' rent and from disconnecting air conditioning until an eviction proceeding is complete. The bill also declares that each residential lease contract is "deemed to include a provision that the premises is fit for human habitation," though the bill does not define "fit for human habitation." Oppose is the Limited Government Position as this infringes property rights and exposes landlords to greater risk - which drives up housing costs and rental rates.

This bill allows "cottage food operators" to produce and sell certain "non-potentially hazardous" homemade food products directly, online, through the mail, and through retail establishments. Support is the Limited Government Position as this bill strengthens individual liberties and the ability of consumers to purchase a greater range of products at farmer's markets and other locations across the state.

Expanding Food Freedom and Consumer Choice by Allowing Sales of Certain Homemade Food Products.

This bill, the "Personal Privacy Protection Act," prohibits government agencies from requiring nonprofit organizations to disclose private donor lists or lists of members or supporters. Agencies also may not make such information publicly available or require contractors or grant recipients to disclosure nonprofit organizations that they have supported. Protecting First Amendment Rights by Prohibiting Agencies from Requiring Nonprofits to Disclose Donors.

The bill also prohibits state agencies from contracting "with a media reliability and bias monitor or with any advertising or marketing agency that utilizes a media reliability and bias monitor on services provided to the state." Support is the Limited Government Position as this bill protects against significant and unnecessary threats from U.S. foreign adversaries.

Strengthening National Security by Restricting State Agencies from Contracting with Companies Controlled by China and Other U.S. Foreign Adversaries.

This bill, the "Georgia Criminal Alien Track and Report Act of 2024," requires law enforcement agencies to comply with federal immigration detainers and provides for the withholding of state and federal funds from localities that prohibit communicating immigration status information with government agencies. The bill also makes it a misdemeanor if law enforcement officers fail to comply with provisions requiring immigration status verification of individuals in custody. Support is the Limited Government Position as the promotion of an open-border immigration system places an immense strain on U.S. infrastructure and taxpayer resources, ranging from welfare to the education system, while also creating serious national security and human trafficking issues.

Strengthening National Security by Withholding State and Federal Funds from Localities that Refuse to Comply with Federal Immigration Detainers.

This bill accelerates the gradual reduction of the state's income tax from 5.49% to 4.99%. Under the bill, the rate for 2024 is reduced from 5.49% to 5.39%. As the tax rate is set to decrease by .10% annually, the tax rate will reach 4.99% one year earlier. Support is the Limited Government Position as all state and local tax codes should be constructed in a broadly applied manner with the lowest rates possible for everyone.

Expanding Economic Growth by Accelerating the Reduction of the Income Tax Rate.

This bill reduces the corporate tax rate by making it equal to the individual tax rate. Beginning 2024, this rate is 5.39%, and reduces by .10% annually until reaching 4.99%. Previously, the corporate tax rate was 5.75%. Support is the Limited Government Position as this tax cut will drive businesses to Georgia and unleash economic growth by keeping a greater amount of resources in the private sector where they can be reinvested.

Expanding Economic Growth by Lowering the Corporate Tax Rate to Equal the Individual Tax Rate.

This bill amends the Georgia Entertainment Industry Investment Act by increasing requirements to qualify for the 10% income tax credit. Production companies are required to spend at least $500,000 on an individual production (rather than "qualified production activities") or $10 million on all productions. Companies must also meet at least four of ten criteria, such as at least 50% of crew members being Georgia residents, at least 50% of vendors being Georgia vendors, and the production "company participates in or supports at least one Georgia workforce development program." The bill also limits transfers of credits among companies to 2.5% of the budget in the annual appropriations bill. Support is the Limited Government Position as, while lawmakers should eliminate this tax credit entirely, this bill slightly decreases cronyism by strengthening qualification requirements.

Slightly Reducing Cronyism by Making it Harder for Woke Hollywood Production Companies to Receive Taxpayer Subsidies.

This bill amends the state's low-income housing project tax credit to reduce the credit to 80% of the federal housing tax credit (previously 100%), except for certain projects. Under the bill, a "targeted community project" will still receive 100% of the federal housing tax credit, and includes affordable housing projects that meet certain criteria, such as being "located in a rural area" or "owned by a housing authority." Support is the Limited Government Position as this bill helps reduce cronyism that enriches select developers through government central planning. Lawmakers should empower the free market to make housing truly "affordable" by reducing stringent zoning regulations.

This bill suspends new sales and use tax exemptions for data centers for two years, through June 30, 2026. The bill also establishes a "Special Commission on Data Center Energy Planning" to evaluate and provide recommendations related to data center energy usage. Temporarily Reducing Cronyism Through a Two-Year Suspension of the Data Center Sales Tax Exemption.

This bill reduces the minimum property tax rate that school districts must impose in order to receive state education equalization funds. Under the bill, the minimum rate is reduced from 14 mills to 10 mills. If a district imposes a rate below the minimum amount, their state equalization funds are reduced by 25%. Support is the Limited Government Position as all state and local tax codes should be constructed in a broadly applied manner with the lowest rates possible for everyone.

Providing Property Tax Relief by Reducing the Minimum Property Tax Rate School Districts Must Impose to Receive State Funds.

This bill exempts individuals who provide "shampooing or blow-dry styling" services from the state's cosmetology and barber licensing requirements. This includes services such as drying and styling hair, without using flat or curling irons. The bill also removes restrictions on cosmetics that can be applied without a license. Support is the Limited Government Position as the state's draconian Board of Cosmetology and Barbers - which should be eliminated entirely - represents one of the very worst forms of cronyism and government overreach. This government entity merely exists to restrict competition and enrich cosmetology and barber schools through outrageous occupational licensure requirements for services which present little to no risk to consumers.

Slightly Reducing the State's Overreaching Cosmetology Licensing Mandates.

This bill requires companies to meet conditions related to labor unions in order to be eligible for certain economic development incentives. Under the bill, to be eligible, a company may only recognize a union if a secret ballot was used by employees, rather than authorization cards. Additionally, companies may not provide personal contact information of employees to a labor union without the employees' consent. Companies also may not require subcontractors to violate either of the requirements. If a company violates these provisions, any economic development incentives must be repaid. Support is the Limited Government Position as, while it is not the role of government to provide economic development incentives in the first place, this bill promotes the "right to work" without being forced to join a union.

Strengthening "Right to Work" Protections by Requiring Secret Ballots as a Condition for Companies to Receive Economic Development Incentives.

This bill prohibits the use of politicized ESG (environmental, social, and governance) considerations in public retirement systems investments, which may reduce taxpayer returns. Support is the Limited Government Position as all public investment actions should be based on producing the maximum return and value for taxpayers, not advancing political or social agendas.

Protecting Taxpayers by Prohibiting ESG (Environmental, Social, and Governance) Considerations in State Investments.

This bill allows the Department of Corrections to issue an identification card to individuals who are released from prison, as well as a record of the educational and job training programs the person completed while incarcerated. Support is the Limited Government Position as this bill provides reformed individuals with the means to obtain gainful employment, one of the largest factors in preventing recidivism, which is critical considering the national 44% recidivism rate.

Reducing Recidivism by Helping Reformed Individuals Gain Employment by Providing Released Inmates with Identification Cards and Records of Educational and Work Programs.

This bill, the Georgia Farmland Conservation Act, creates a new fund for a "Purchase of Agricultural Conservation Easement" program designed to prevent farmland from being developed. Under the program, farmers are paid for their land's development rights if the land may be "susceptible to development" for things such as housing or retail. Oppose is the Limited Government Position as the private sector is best equipped to manage and maximize land utilization - including for conservation purposes. Measures such as this merely drive-up taxpayer costs and oftentimes lead to even greater future government spending surrounding usage and preservation of the conserved land.

Fueling Wasteful Spending through the Creation of the "Georgia Farmland Conservation Fund" to Incentivize Farmland Conservation and Food Production.

This bill prohibits outside groups from funding the administration of election operations, unless the value of the contribution is under $500. The bill is in response to "Zuckerbucks" and the hundreds of millions outside groups spent in 2020 for election administration, including $45 million for the administration of election operations in Georgia. Support is the Limited Government Position as privately funding election operations introduces serious concerns over their integrity and fairness of election outcomes, an essential component of democracy under our nation's constitutional republic.

Strengthening Election Integrity by Prohibiting Private Funds for Election Administration.

This bill provides reciprocity for individuals in Georgia who may hold occupational licenses issued in other states. The bill applies to most cases in "which the training, experience and testing are substantially similar in qualifications and scope," while still allowing state licensing authorities to require individuals to pass an exam on Georgia laws and regulations. Support is the Limited Government Position as this bill helps reduce unnecessary regulatory barriers. Ultimately though, the private sector, via certifications, rating systems, and the free market, is much better equipped to provide consumer protection while also ensuring competition and low consumer costs. Most government licensing entities are overly restrictive and are largely advocated by special interests seeking to restrict competition in the marketplace.

Expanding Competition and Reducing Barriers to Employment through Occupational Licensing Reciprocity.

This bill provides an automatic tax refund for all taxpayers who filed a 2021 and 2022 tax return. The refund is equal to the taxpayer's 2021 tax liability or $250 for individual taxpayers, $375 for a head of household, or $500 for married couples filing a joint return, whichever is less. Support is the Limited Government Position as while the $1 billion in funds should have been used to reduce the top tax bracket (as opposed to wealth redistribution through a flat $250 refund), the bill represents a step in the right direction to returning resources to the private sector.

Providing Slight Tax Relief through an Automatic Tax Refund Ranging between $250 and $500.

This bill is intended to help reduce staffing shortages through changes to the qualifications to become a constable. Under the bill, the minimum age to become a constable is reduced from 25 to 21 and the county residency requirement is eliminated. The requirements that an individual be a U.S. citizen, a registered voter, and have a high school diploma or GED remain unchanged.
